A class action law suit, filed on April 20, 2000, by West Virginia University employees seeking medical monitoring for potential asbestos-related health problems as a result of working in University buildings containing asbestos insulation, was preliminarily settled Tuesday (Nov. 22). The settlement was submitted to Judge Kaufman today.

WVU maintains that all standard, recognized practices for asbestos removal have been followed over the years, and that the general population of employees, through routine monitoring of buildings and air samplings, remain safe from any harmful effects of asbestos-containing materials.

However, in the spirit of compromise, a preliminary settlement has been reached wherein class members will be eligible for proactive medical surveillance for asbestos-related health problems, should they qualify under the agreement. (The full agreement is available for download here.)

The hearing for final approval to allow class members to voice objections to the proposed settlement will be on Dec. 22 at 10 a.m. in Kanawha County Circuit Court.
